This Privacy Policy explains how CapX, Construction Automation, Inc. or Capasso Enterprises, and their affiliates and subsidiaries that post or link to this Policy (collectively, "CapX," "we," "us," or "our") collect, use, disclose, retain, and protect personal information when individuals access or use our websites, mobile applications, social networking features, messaging tools, workforce tools, recruiting tools, company pages, APIs, integrations, and related services (collectively, the "Services").
CapX is intended to support professional networking, workforce coordination, project collaboration, recruiting, credentialing, communications, payments, and related business functions in the construction and skilled trades ecosystem. Because the Services may involve professional profiles, user generated content, payments, precise location information, contact syncing, and connected email or calendar tools, we may process information that is considered "sensitive personal information" or "sensitive data" under certain laws.
This Policy is meant to function as a public facing privacy notice. Additional terms, consents, just in time notices, cookie banners, in app settings, click through disclosures, data processing addenda, and sector specific notices may also apply depending on how you use the Services.
This Policy applies to job applicants, account holders, platform users, company administrators, recruiters, subscribers, contractors, visitors, and other individuals whose information we process in connection with the Services.
This Policy does not apply to third party websites, apps, payment providers, job boards, operating systems, wireless carriers, social media platforms, or other services that maintain their own privacy policies, even if they are linked to or accessible through the Services.
We may collect the following categories of personal information depending on the features you use and the choices you make.
We collect information directly from you, automatically from your use of the Services, from your devices, from companies or administrators that provision access for you, from service providers, from integrated third party services you choose to connect, from other users who interact with you, and from publicly available or commercially available sources where lawful.
If you connect email, contact, calendar, identity, or payment tools, the scope of information we collect depends on the permissions, APIs, and settings you authorize. You may disconnect those integrations through the applicable settings, although previously collected information may remain subject to this Policy and our retention obligations.
We use personal information to operate, provide, maintain, improve, secure, support, and personalize the Services; create and administer accounts; authenticate users; provide networking, recruiting, messaging, workforce, attendance, or payment features; fulfill transactions; respond to inquiries; provide customer support; detect and prevent fraud, abuse, or security incidents; enforce our terms and community rules; audit and improve performance; develop new features; comply with legal obligations; protect rights and property; and otherwise run our business.
We may also use information to recommend content, companies, opportunities, users, groups, projects, or tools you may find relevant; to provide contextual or interest based marketing where lawful; to measure ad or campaign performance; and to create aggregated, de identified, or anonymized analytics, benchmarks, or industry insights.
Where required by law, we obtain consent before processing sensitive data, enabling precise location collection, accessing connected email or contact sources, sending certain marketing communications, or using cookies and similar technologies for targeted advertising or non essential analytics.
Because CapX may process financial information, precise geolocation, contents of communications, verification data, and data from connected accounts, we treat certain categories of information as especially sensitive. We do not use or disclose sensitive data except as reasonably necessary to provide requested features, comply with law, protect the Services, perform internal business operations, or as otherwise permitted or required by applicable law.
If a feature requires sensitive data, we may provide an in app disclosure, permission request, or other just in time notice. You may decline certain requests, but some features may not function properly without the relevant data.
If CapX ever offers biometric verification, facial comparison, fingerprint, voiceprint, or similar features, CapX will publish a supplemental notice describing the purpose, retention period, deletion standards, consent flow, and any state specific rights that apply before collecting that information.
We may use approximate or precise location information to support jobsite check in functions, fraud prevention, attendance verification, project assignment logic, local networking suggestions, safety features, and region specific content. You can usually disable precise location access through your device settings, but some location based functions may no longer operate as intended.
CapX does not require continuous background location access unless a specific feature is clearly disclosed and activated by you or your organization. If background location is ever used, CapX will provide an enhanced notice describing when collection occurs and how you can disable it.
If you choose to connect Gmail, Outlook, Microsoft 365, Apple, LinkedIn, or other communication or identity providers, CapX may receive the data categories and scopes authorized by you through those providers' APIs and permission screens. Depending on the integration, this may include contact lists, profile information, email headers, message content, calendar events, and metadata needed to provide synchronization, invitation, messaging, login, productivity, or workflow features.
CapX will not access or use connected account data beyond the permissions granted by you and the limits described in this Policy, our just in time notices, and the applicable provider terms. We do not claim ownership of your email or calendar content. We use connected data only to provide requested functionality, improve service quality, prevent abuse, comply with law, or as otherwise disclosed at the time of collection.
You may revoke provider access through your CapX settings and, in some cases, through the connected provider account itself. Revocation does not affect processing that occurred before revocation.
If you purchase subscriptions, receive payouts, reimburse expenses, or otherwise use payment related features, CapX and its payment vendors may process billing details, payment card metadata, transaction records, tax forms, bank account or payout details, fraud signals, and related records. Full payment card numbers are typically processed by PCI compliant payment processors rather than stored directly by CapX, except as tokenized or otherwise returned by the processor.
We may use financial information to process transactions, prevent fraud, comply with tax and accounting obligations, manage chargebacks and disputes, and maintain required business records.
CapX may use cookies, tags, pixels, local storage, software development kits, session replay tools, and similar technologies to authenticate users, keep the Services secure, remember settings, analyze usage, improve performance, measure campaigns, detect fraud, and support advertising or social sharing tools where lawful.
Depending on your state, you may have rights to opt out of targeted advertising, certain profiling, or certain forms of data sale or sharing as those terms are defined by law. CapX may honor browser based or device based universal opt out preference signals where required by law.
We may disclose personal information to affiliates; service providers; cloud hosting vendors; analytics vendors; identity verification providers; payment processors; communication providers; customer support vendors; security vendors; professional advisors; insurers; auditors; prospective merger or financing counterparties; law enforcement; regulators; and other parties where disclosure is reasonably necessary for the purposes described in this Policy.
We may also disclose information to other users, companies, recruiters, project owners, or administrators based on your settings, your posted content, your use of networking or recruiting tools, or your organization's account configuration.
We do not sell personal information for money. However, some digital advertising, analytics, audience matching, or cross context behavioral advertising practices may be treated as a "sale," "sharing," or "targeted advertising" under certain state laws. Where required, we provide methods to opt out of those activities.
Any information you post in public or semi public areas of the Services, including profile fields, company pages, posts, comments, project showcases, endorsements, and similar content, may be visible to other users, recruiters, companies, or the public depending on your settings and the nature of the feature. Please do not post confidential, proprietary, or highly sensitive personal information in public areas of the Services.
CapX is not responsible for how other users or third parties use information you choose to make public or otherwise disclose through the Services.
Residents of certain states may have the right to opt out of targeted advertising, the sale of personal data, or profiling in furtherance of decisions that produce legal or similarly significant effects. Where those rights apply, CapX will make available a clear method to exercise them, such as through a footer link, in app control, cookie banner, or browser based universal opt out signal handling.
CapX does not knowingly use data from connected email, private messages, precise geolocation, financial account details, or other sensitive data for targeted advertising except where clearly disclosed and lawfully permitted.
Depending on your state of residence and subject to verification, exemptions, and applicable law, you may have rights to: access personal information; confirm whether we process your information; receive a portable copy of certain data; correct inaccurate information; delete certain information; opt out of targeted advertising, sale, sharing, or certain profiling; appeal certain privacy request denials; and limit the use or disclosure of sensitive personal information where such a right applies.
You may submit privacy requests through our privacy settings, by emailing our privacy team, or by calling our support line. We may need to verify your identity before acting on your request. Authorized agents may submit requests where permitted by law, subject to identity and authority verification.
If we deny a request in whole or in part, we will explain how you may appeal where an appeal right is required by applicable law.
For California residents, this section is intended to supplement the rest of the Policy and provide notice under the California Consumer Privacy Act, as amended by the California Privacy Rights Act. CapX collects the categories of personal information listed in Section 3 above for the business and commercial purposes described in Sections 5 through 13 above. CapX discloses those categories to the categories of recipients described in Section 11 above.
California residents may have rights to know, access, correct, delete, opt out of sale or sharing, limit the use and disclosure of sensitive personal information, and be free from unlawful discrimination for exercising privacy rights. CapX does not use sensitive personal information to infer characteristics about you except as permitted by law and as necessary to provide requested services, maintain security, or perform other permitted business purposes.
CapX retains personal information for as long as reasonably necessary and proportionate for the purposes described in this Policy, taking into account the nature of the information, the purpose for collection, operational necessity, legal obligations, dispute risk, and security requirements.
Residents of Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, Iowa, Indiana, Tennessee, Delaware, New Hampshire, New Jersey, Nebraska, Minnesota, Maryland, Kentucky, Rhode Island, and other states with applicable privacy laws may have certain privacy rights, subject to thresholds, exemptions, and applicability rules under those laws. CapX intends for this Policy to provide a baseline disclosure framework that can be supplemented by state specific notices, opt out mechanisms, and request workflows where required.
If a state law applicable to CapX requires opt in consent for processing sensitive data, precise geolocation, children's data, biometric data, or personal data for targeted advertising or profiling, CapX will request consent in the manner required by that law before engaging in that processing.
CapX is not directed to children under 13, and we do not knowingly collect personal information from children under 13 without the legally required notice and verifiable parental consent. If we learn that we collected personal information from a child under 13 without appropriate authorization, we will take steps to delete the information as required by law.
If CapX allows users between 13 and 17 to access certain features, CapX may provide age appropriate settings, notices, consent flows, or advertising restrictions as required by applicable law. CapX may suspend or terminate accounts that violate age restrictions or platform rules.
CapX uses administrative, technical, organizational, and physical safeguards designed to protect personal information against unauthorized access, disclosure, alteration, or destruction. These measures may include encryption in transit and at rest where appropriate, least privilege access controls, logging, vendor diligence, authentication controls, rate limiting, backup procedures, incident response planning, and workforce training.
No system is completely secure. You are responsible for maintaining the confidentiality of your credentials and promptly notifying us if you suspect unauthorized access or misuse of your account.
CapX retains personal information for as long as reasonably necessary for the purposes described in this Policy, including to maintain accounts, provide requested services, complete transactions, preserve business and tax records, investigate incidents, comply with law, resolve disputes, and enforce agreements.
Retention periods may vary by data type. For example, account and profile data may be retained while your account is active; payment and tax records may be retained for longer periods required by law; security logs may be retained for a period reasonably necessary to detect and respond to incidents; and backup archives may persist for a limited time after deletion. CapX may de identify or anonymize certain data and retain it in a form that no longer reasonably identifies an individual.
CapX is based in the United States and may process personal information in the United States and other jurisdictions where our service providers or affiliates operate. By using the Services, you understand that your information may be transferred to and processed in jurisdictions that may not provide the same level of legal protection as your home jurisdiction, subject to applicable legal requirements.
CapX may use automated systems to rank feed content, identify suspected fraud, recommend connections or job opportunities, verify likely account authenticity, moderate content, or route support requests. We do not rely on solely automated processing to make decisions that have legal or similarly significant effects on individuals unless lawful and accompanied by required rights, disclosures, and human review procedures.
If CapX is involved in a merger, acquisition, financing, reorganization, bankruptcy, asset sale, or similar transaction, personal information may be disclosed to counterparties, advisors, lenders, investors, and acquiring entities subject to confidentiality and lawful transfer requirements.
We may update this Privacy Policy from time to time. When we do, we will revise the "Last Updated" date above and, where required by law, provide additional notice or obtain consent before material changes take effect.
